Firm prosecuted over worker crush injuries

A firm has been prosecuted following an incident in which a man sustained an injury at work. The Health and Safety Executive (HSE) took legal action after a 58-year-old mechanical engineer suffered serious physical harm while working underneath a vehicle.

The individual was performing his role at the Original London Sightseeing Tour Limited in October 2009 when he was crushed.

He had been reseating an airbag on an open topped bus while the vehicle was raised two feet from the ground on its axels by wooden blocks and column vehicle lifts.

The individual, who does not wish to be named, was assisted by his colleague, who was responsible for raising and lowering the bus using a lift control.

During their activities, one of the wooden blocks broke and the axel dropped onto the mechanic. Due to the force of the impact, he sustained a broken pelvis and ribs and was hospitalised for two weeks.

Meanwhile, he was unable to work for six months after the accident and still suffers from pain.

Individuals who sustain harm like this often make compensation claims in a bid to receive money and make their lives easier. Payouts can help to cover any medical expenses incurred, as well as lost earnings.

Commenting on the case, HSE inspector Jane Wolfenden said: “The use of wooden blocks in this way could easily have resulted in a fatality. It was foreseeable that the blocks were likely to give way, putting the lives of employees at risk.

“Had the company carried out an effective risk assessment that involved site engineers, this entirely preventable incident could have been avoided.”

As a result of the case brought by the HSE, the firm was issued a fine of £10,500 and ordered to pay costs of £10,000 due to breaches in health and safety laws.
